Terms of Service

1. Acceptance

By accessing or using Fluxi (the "Service"), operated by Fluxi Intelligence S.L. ("Fluxi", "we"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Service description

Fluxi is a B2B revenue intelligence platform that analyzes CRM and sales data to generate forecasts, recommendations, and automate go-to-market workflows.

3. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 16 years old and legally authorized to represent the organization you register on behalf of.

4. Acceptable use

You agree not to:

• Use the Service for illegal purposes.
• Reverse engineer, decompile, or attempt to extract the source code.
• Scrape or bulk-export data through unauthorized means.
• Upload malicious code or attempt to breach security.
• Attempt to bypass, disable, or exploit the Service's security measures.
• Use the Service to compromise other systems or extract data from third-party services without authorization.
• Impersonate any person or entity.
• Use the Service to send unsolicited communications.

5. Integrations

The Service integrates with third-party platforms (HubSpot, Gmail, Base Loop, Clay, Slack, and others). By connecting these, you authorize Fluxi to access and process the relevant data on your behalf. Third-party platforms are subject to their own terms.

6. Intellectual property

Fluxi and all its content, features, and functionality (including software, design, text, and logos) are owned by Fluxi Intelligence S.L. and protected by intellectual property laws. Your data remains yours.

7. Subscription and billing

Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by law. We may change pricing with 30 days' notice. You can cancel at any time; cancellation takes effect at the end of the current billing period.

8. Service availability

We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance whenever possible.

9. Limitation of liability

To the maximum extent permitted by law, Fluxi is not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability is limited to the amount paid by you in the 12 months preceding the claim.

10. Warranty disclaimer

The Service is provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Termination

We may suspend or terminate your account if you breach these Terms. You may terminate your account at any time from your settings.

12. Governing law

These Terms are governed by Spanish law. Any dispute shall be resolved by the courts of Valencia, Spain.

13. Security incident response

In the event of a security incident affecting your data, Fluxi will notify you within 72 hours of becoming aware of the incident, in accordance with GDPR, and provide a description of the incident, the data affected, and the measures taken in response.

14. Changes

We may update these Terms. Material changes will be communicated at least 30 days before taking effect.
